1. Acceptance of Terms

By accessing or using AGStealth VPN services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all users, visitors, and others who access or use the Service.

2. Description of Service

AGStealth provides a Virtual Private Network (VPN) service that encrypts your internet traffic and routes it through our servers located across multiple regions worldwide. The Service is operated by AG Enterprise and is intended for lawful privacy and security purposes.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Account Registration

To access the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You are strictly prohibited from using the Service to:

• Engage in any illegal activity or violate any local, national, or international laws
• Transmit or distribute malware, viruses, or any malicious code
• Conduct unauthorized network scanning, port scanning, or hacking attempts
• Send spam, unsolicited messages, or engage in phishing activities
• Infringe upon intellectual property rights of others
• Distribute child sexual abuse material or any illegal content
• Engage in activities that violate the laws of India or your country of residence
• Attempt to circumvent or disable security features of the Service
• Resell or redistribute the Service without prior written authorization

6. Subscription and Payment

AGStealth offers subscription-based plans. By subscribing, you agree to:

• Pay the applicable subscription fee for your chosen plan
• Provide accurate and valid payment information
• Authorize us to charge your payment method for the subscription period

All prices are displayed in USD. Payments are processed securely through Razorpay. We reserve the right to change subscription prices with 30 days notice.

7. Refund Policy

We offer a 7-day money-back guarantee for first-time subscribers who are not satisfied with our Service. Refund requests must be submitted within 7 days of the initial payment by contacting ag.enterpr@agstealth.com. Refunds are not available for renewals or accounts found to have violated these Terms.

8. Data Limits and Fair Use

Each subscription plan includes a specified data limit per billing period. Unused data does not roll over to the next period. We reserve the right to throttle or suspend accounts that engage in excessive usage that negatively impacts other users, even within stated data limits.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access to the Service. We reserve the right to perform maintenance, updates, or modifications that may temporarily affect availability. We are not liable for any downtime or service interruptions.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms. You may cancel your subscription at any time through your account dashboard. Upon termination, your access to the Service will cease immediately.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted. Your use of the Service is at your sole risk.

12. Limitation of Liability

To the maximum extent permitted by applicable law, AGStealth and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to defend, indemnify, and hold harmless AGStealth, AG Enterprise, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Service; (c) your violation of any third-party right, including any intellectual property right or privacy right; or (d) any claim that your use of the Service caused damage to a third party.

14. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the AUP may result in immediate termination of your account.

15. DMCA and Copyright

We respect intellectual property rights. Our DMCA Policy governs how we handle copyright infringement notices. Due to our no-logs architecture, we are unable to identify users from IP addresses reported in DMCA notices.

16. Data Processing

Where applicable, we act as a data controller for account and payment information. Our third-party service providers act as data processors under Data Processing Agreements (DPAs). Current processors include:

• Razorpay — payment processing (India)
• Hetzner Online GmbH — panel server hosting (Germany)
• VPN node hosting providers — multiple regions worldwide

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kerala, India.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Your continued use of the Service after changes constitutes your acceptance of the new Terms.
